Right of Withdrawal
1.) Withdrawal Policy
Introduction
Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional activities:
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (mypado GmbH, Zinkhüttenweg 17, 44143 Dortmund, Tel.: +49 (0) 231 565 596 60, Fax: +49 (0) 231 565 596 22, E-Mail: support@mypado.de) by means of a clear statement e.g. a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.
To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Consequences of Withdrawal:
If you withdraw from this contract, we shall reimburse all payments received from you, including delivery costs (except for additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise; in no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
Customers in Germany have the option to request a return label from us. With this return label, the goods can be returned to us via DHL or DPD. A fee of €5.95 per return will be deducted directly from your refund.
Alternatively, you can return the goods at your own expense. You bear the direct costs of returning the goods.
You are only liable for any diminished value of the goods if this loss in value is due to handling that is not necessary to check the nature, characteristics and functioning of the goods.
Exclusion / Expiry of the Right of Withdrawal
The right of withdrawal does not apply, among others, to contracts
- for the supply of goods that are not prefabricated and for whose manufacture an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.
The right of withdrawal expires prematurely, among others, in the case of contracts
- for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.
